Lease Breakage

Effective with new lease agreements signed on or after January 1, 2016, Associates must recieve a "Certificate of Compliance" from the TCS Relocaiton Center to be eligible for the reimbursement of excess rent and or lease breakage fees.  The Certificate of Compliance may be obtained at the time you sign your new lease by complying with the following criteria:

1.  Right-Size Your Lease:

Associate must sign a lease that is less than or equal to the anticipated duration of your assignment. 

In the event that the duration of your assignemnt is not known, your best efforts in matching your lease term to your assignment will be sufficient.

2.  Job Transfer Language:

Associate must attempt to incorporate the following language into their lease agreement: 

"In the event of a change in employment whereby tenant's employer as of the date of execution of this lease requires tenant to relocate to an area greater than 50 miles away from the property, tenant shall upon not less than 30 days advance notice to the landlord of the need to terminate this lease in turn, be relieved of the obligation of future rent payments, so long as a new tenant to re-let the property is obtained during the 30 day notice period. Landlord reserves the right to request written confirmation from the employer of such job transfer. In the event that tenant and landlord are unable to find a new tenant to re-let the property within 30 days of the notice to terminate the lease, landlord may receive up to a maximum of 1 month’s rent from tenant as full compensations for damages due to early termination.”

3.  Relo Center Housing Options:

Associate must select one of the options presented by the TCS Relo Center for their permanent housing.

The Relo Center will obtain a needs assiessment detailing the needs and desires of the Associate and will match the specific information with the TCS Associate Housing Database and pre-selected communities to source availability that meets the Associates criteria.  Several options will be made available to the Associate.

Compliance with the criterion above will allow your Relocation Coordinator to issue you a Certificate of Compliance.  You will want to hold on to this Certificate in the event that you are relocated again.  The TCS Relo Center will also maintain a copy of your Certificate of Compliance.
